GENERAL TERMS AND CONDITIONS
- SCOPE OF APPLICATION
These General Terms and Conditions (GTC) apply to all orders placed through our online shop. They are available in their current version on our website at https://aromachic.net/ under the section GTC.
- CONTRACTUAL PARTNER, CONCLUSION OF CONTRACT, CORRECTION POSSIBILITIES
The purchase contract is concluded with TRADE PEAK LIMITED.
The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding online catalogue. You can initially place our products in the shopping cart without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained in the ordering process. By clicking the order button, you make a binding offer for the goods contained in the shopping cart. The acknowledgment of receipt of your order is sent by email immediately after submitting the order.
We accept your offer within two days by:
- sending a declaration of acceptance in a separate email, or
- if applicable, the payment transaction is carried out by our service provider or the selected payment service provider. The timing of the payment transaction depends on the selected payment method (see under "Payment").
The relevant alternative for you depends on which of the listed events occurs first.
- CONTRACT LANGUAGE, STORAGE OF THE CONTRACT TEXT
The language available for the conclusion of the contract is Spanish. We save the contract text and send you the order data and our GTC in text form.
- DELIVERY
(1) In addition to the product prices indicated, shipping costs are added. You can find details about the amount of shipping costs with the offers and in our shipping information under shipping costs.
We only deliver via shipping. Unfortunately, it is not possible to pick up the goods yourself.
(2) Goods in stock are delivered domestically within 3 to 5 working days by mail. For shipments outside Europe, the delivery takes 10 to 14 working days if the goods are available.
(3) Should an item exceptionally not be available or not as quickly deliverable, we will inform you of the delivery date as soon as possible, or alternatively, that delivery cannot be made. We reserve the right to make a partial delivery if it seems advantageous for a quick settlement and if it is reasonable for you. Partial deliveries do not limit or exclude your statutory warranty rights. Should there be a partial delivery, we will of course bear the additional shipping costs. This will not result in any further costs for you.
(4) Should we be unable to deliver the goods you have ordered through no fault of our own, because our supplier does not fulfil his contractual obligations, we expressly reserve the right to withdraw from the contract. In this case, we commit to inform you immediately about the non-availability of the goods and to reimburse any services already received from you immediately.
(5) If adherence to deadlines is not possible due to force majeure, such as mobilisation, war, riots, or similar events, e.g., strikes or lockouts, the deadlines shall be extended appropriately.
- INSTRUCTIONS ON WITHDRAWAL
Right of Withdrawal
You have the right to withdraw from this contract within fourteen days without giving any reason.
The withdrawal period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has taken possession of the goods. To exercise your right of withdrawal, you must inform us (TRADE PEAK LIMITED, 11 86-90 Paul Street, London, Greater London, England, EC2A 4NE, Email: support@aromachic.net) by means of a clear statement (e.g., by email, fax, or letter sent by post) of your decision to withdraw from this contract. You may use the withdrawal form provided by us, which we make available at the following link: Withdrawal Form. However, it is not obligatory to use this form to exercise your right of withdrawal. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of Withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.
You shall send back the goods or hand them over to us without undue delay and in any event not later than fourteen days from the day on which you communicate your withdrawal from this contract to us. The deadline is met if you send back the goods before the period of fourteen days has expired. The return of the goods is at your expense. You are only liable for any diminished value of the goods resulting from the handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

- PRICES
The prices valid at the time of the conclusion of the contract are those from the currently valid catalogue or those published on our website at https://aromachic.net at the time of the contract conclusion.
- POSTAGE AND SHIPPING COSTS
We deliver with DireX and their local partners.
(1) For orders over 120.00 €, we deliver free of charge within selected European countries. For orders under 120.00 €, we charge a flat rate for shipping and handling of 4.95 € for deliveries.
*There may be exceptions for island countries and countries outside the European Union.
(2) Shipping costs and return costs for international deliveries are borne by the buyer. Customs duties and taxes are generally incurred when importing into a non-EU country. The proper customs clearance of the goods is the responsibility of the buyer; please inform yourself about the duties and taxes levied in your country before ordering.
- PAYMENT TERMS
In our shop, the following payment methods are generally available:
Cash on Delivery
You pay the purchase price directly to the deliverer. No additional costs are incurred for this.
Credit Card Payments Coming Soon
Pay conveniently by credit card in the aromachic.net online shop. We accept credit card payments, currently American Express, Master Card, and Visa. Refunds due to a return of goods will be credited to your credit card account.
The integrated SSL procedure ensures the security of data transmission for credit card payments.
If your credit card provider participates in the 3D Secure procedure (security procedure and authentication of your credit card), you may be asked to enter your PIN at the end of your order. If you have any questions about registering for the 3D Secure procedure, please contact your credit card provider directly.
Due to an EU directive, we are obliged to carry out 2-factor authentication for payments by credit card.
The EU directive PSD2 states that in the future, one may be asked in a separate step to confirm one's identity with 2 factors for online payments.
If you have not done so already, please contact your bank and ask about the methods of authentication they offer. This can be a code sent via SMS or email or a fingerprint in a banking app. Once the process is initiated, card payments will become even more secure.
For customers who do not use a smartphone, alternative identification methods are available, such as a TAN generator or sending the PIN via SMS.
Which systems are offered is up to the respective credit institutions.
- RETENTION OF TITLE
The goods remain our property until full payment is made.
- TRANSPORT AND TRANSPORT DAMAGES
We deliver with DireX and their local partners. Please check the goods for damages upon receipt. If goods are delivered with obvious transport damage, please claim such defects immediately upon delivery and contact us without delay. The failure to make a complaint or to contact us has no consequences for your statutory claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.
- WARRANTY AND GUARANTEES
Unless expressly agreed otherwise below, the statutory warranty rights apply. The limitation period for claims for defects is one year from delivery of the goods for used items. The aforementioned limitations and shorter periods do not apply to claims for damages caused by us, our legal representatives, or vicarious agents
- in case of injury to life, body, or health,
- in case of intentional or grossly negligent breach of duty as well as fraud,
- in case of breach of essential contractual obligations, the fulfilment of which enables the proper execution of the contract in the first place and on the compliance of which the contractual partner may regularly rely (cardinal obligations)
- within the scope of a guarantee promise, if agreed, or
- as far as the scope of the Product Liability Act is opened.

- LIABILITY
For claims based on damages caused by us, our legal representatives, or vicarious agents, we are always liable without limitation
- in case of injury to life, body, or health,
- in case of intentional or grossly negligent breach of duty,
- with guarantee promises, as far as agreed, or
- as far as the scope of the Product Liability Act is opened.
In the case of a breach of essential contractual obligations, the fulfilment of which enables the proper execution of the contract in the first place and on the compliance of which the contractual partner may regularly rely, by slight negligence on our part, our legal representatives or vicarious agents, the liability is limited in amount to the foreseeable damage at the time of contract conclusion, which must typically be expected. Otherwise, claims for damages are excluded.
- DISPUTE RESOLUTION
The European Commission provides a platform for online dispute resolution (ODR), which you can find here https://ec.europa.eu/consumers/odr/. We are ready to participate in an extrajudicial arbitration procedure before a consumer arbitration board. - DATA STORAGE
(1) We store, process, and use the personal data provided by you on the order form to process your order. We pass on some of this data to the transport companies we have commissioned for order processing (e.g., delivery and package announcement).
(2) Upon written request, you will receive a list of the data stored about you free of charge. Incorrectly stored data will be corrected upon your written request. Insofar as you have consented to a use of your personal data that is not already legally permitted, you can revoke this consent at any time.
- APPLICABLE LAW AND JURISDICTION
(1) These conditions, as well as all contracts concluded under these conditions and the disputes arising from them, are subject to Еuropean law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
(2) We strive to resolve any disagreements quickly and without bureaucracy. For all disputes arising from or in connection with these conditions and the individual contracts, Freiburg is the exclusive place of jurisdiction if your residence or habitual abode at the time of filing the lawsuit is either not in the country or is unknown.
